General Terms and Conditions
- We point out that the property information provided by us originates from the seller or a third party commissioned by the seller and has not been verified by us for accuracy. It is the customer’s responsibility to verify this information. The real estate agent, who merely forwards this information, assumes no liability for its correctness. Errors and interim sale or rental are reserved.
- A brokerage contract with us is concluded through a written agreement or through the use of our brokerage services (dispatch of exposé including the conditions).
- All information, including our property references, is expressly intended for the customer. The customer is expressly prohibited from passing on property references and information to third parties without our explicit consent. If a customer violates this obligation and a third party or other persons to whom the third party has forwarded the information conclude the main contract, the customer shall be obliged to pay us the agreed commission plus VAT.
- A claim for commission also exists in the case of a substitute transaction. Such a case exists, for example, if the client, in connection with our activity, becomes aware of another opportunity to conclude a main contract with the potential contractual partner identified by us, or concludes the main contract with the legal successor of the potential contractual partner, or purchases the identified property instead of renting or leasing it, or vice versa. For a substitute transaction to trigger a commission obligation, it is not necessary that the transaction is economically equivalent to the originally intended one in the sense developed by case law on economic identity.
- Our commission is earned upon notarization of the contract.
- The rights to withhold or offset the commission are excluded unless there is a final legal determination.
- The place of jurisdiction is the registered office of the real estate agent.
- If one or more of the above provisions are invalid, the validity of the remaining provisions shall not be affected. This also applies if part of a provision is invalid, but another part is valid. The invalid provision shall be replaced by a regulation that comes closest to the economic interests of the contracting parties and does not contradict the other contractual agreements.
- We are obliged to inform you, pursuant to the duty to inform about alternative dispute resolution, that the European Commission has established a platform for online dispute resolution (ODR) (http://ec.europa.eu/consumers/odr/).
