Gene­ral Terms and Con­di­ti­ons

  1. We point out that the pro­per­ty infor­ma­ti­on pro­vi­ded by us ori­gi­na­tes from the sel­ler or a third par­ty com­mis­sio­ned by the sel­ler and has not been veri­fi­ed by us for accu­ra­cy. It is the customer’s respon­si­bi­li­ty to veri­fy this infor­ma­ti­on. The real estate agent, who mere­ly for­wards this infor­ma­ti­on, assu­mes no lia­bi­li­ty for its cor­rect­ness. Errors and inte­rim sale or ren­tal are reser­ved.
  2. A bro­kera­ge con­tract with us is con­clu­ded through a writ­ten agree­ment or through the use of our bro­kera­ge ser­vices (dis­patch of expo­sé inclu­ding the con­di­ti­ons).
  3. All infor­ma­ti­on, inclu­ding our pro­per­ty refe­ren­ces, is express­ly inten­ded for the cus­to­mer. The cus­to­mer is express­ly pro­hi­bi­ted from pas­sing on pro­per­ty refe­ren­ces and infor­ma­ti­on to third par­ties wit­hout our expli­cit con­sent. If a cus­to­mer vio­la­tes this obli­ga­ti­on and a third par­ty or other per­sons to whom the third par­ty has for­ward­ed the infor­ma­ti­on con­clude the main con­tract, the cus­to­mer shall be obli­ged to pay us the agreed com­mis­si­on plus VAT.
  4. A cla­im for com­mis­si­on also exists in the case of a sub­sti­tu­te tran­sac­tion. Such a case exists, for exam­p­le, if the cli­ent, in con­nec­tion with our acti­vi­ty, beco­mes awa­re of ano­ther oppor­tu­ni­ty to con­clude a main con­tract with the poten­ti­al con­trac­tu­al part­ner iden­ti­fi­ed by us, or con­clu­des the main con­tract with the legal suc­ces­sor of the poten­ti­al con­trac­tu­al part­ner, or purcha­ses the iden­ti­fi­ed pro­per­ty instead of ren­ting or lea­sing it, or vice ver­sa. For a sub­sti­tu­te tran­sac­tion to trig­ger a com­mis­si­on obli­ga­ti­on, it is not neces­sa­ry that the tran­sac­tion is eco­no­mic­al­ly equi­va­lent to the ori­gi­nal­ly inten­ded one in the sen­se deve­lo­ped by case law on eco­no­mic iden­ti­ty.
  5. Our com­mis­si­on is ear­ned upon nota­rizati­on of the con­tract.
  6. The rights to with­hold or off­set the com­mis­si­on are exclu­ded unless the­re is a final legal deter­mi­na­ti­on.
  7. The place of juris­dic­tion is the regi­stered office of the real estate agent.
  8. If one or more of the abo­ve pro­vi­si­ons are inva­lid, the vali­di­ty of the remai­ning pro­vi­si­ons shall not be affec­ted. This also applies if part of a pro­vi­si­on is inva­lid, but ano­ther part is valid. The inva­lid pro­vi­si­on shall be repla­ced by a regu­la­ti­on that comes clo­sest to the eco­no­mic inte­rests of the con­trac­ting par­ties and does not con­tra­dict the other con­trac­tu­al agree­ments.
  9. We are obli­ged to inform you, pur­su­ant to the duty to inform about alter­na­ti­ve dis­pu­te reso­lu­ti­on, that the Euro­pean Com­mis­si­on has estab­lished a plat­form for online dis­pu­te reso­lu­ti­on (ODR) (http://ec.europa.eu/consumers/odr/).
